NGT's 2023 Order Challenged by Jaipur Municipal Body
The case came up after the Jaipur municipal body filed a petition against the National Green Tribunal’s (NGT) 2023 order. The NGT had mandated that environmental clearances must be obtained before permitting activities, such as a night market near the lake, and directed authorities to comply with regulations for the Nahargarh Wildlife Sanctuary and Eco-Sensitive Zone.
Pollution and Waste Dumping at Jal Mahal Lake
The court condemned the severe pollution at Jal Mahal lake, citing the dumping of dirty sewage water and waste material from the municipal corporation into the lake. It further criticized the decision to allow a night market in the area, which contributed to the contamination of the lake.
Court Rejects Claims of Development Project Benefiting the Lake
The court rejected the municipality's claim that the "so-called development project" was intended to benefit the lake, emphasizing that it had nothing to do with the restoration and preservation of the lake.
Supreme Court Orders Immediate Action
The court directed the Nagar Nigam Jaipur Heritage to work with the National Environmental Engineering Research Institute (NEERI) to prepare a report on immediate pollution control measures and long-term strategies for restoring and preserving the lake. Until NEERI submits its recommendations, the court has prohibited any development or market activities near the lake.
