Russian woman fights for her right to stay in India with her six-month-old daughter after being issued an exit notice by the Ministry of Home Affairs. Bombay High Court urges a compassionate approach and questions the government's stringent rules based on nationalities. Further hearing scheduled for 21st August

The 38-year-old Russian woman claimed she had a six-month-old daughter with an Indian man whom she had remarried.

The woman had been given a leaving permission in January 2023 by the neighborhood police, as per the Union Ministry of Home Affairs' directives, with a March departure deadline. She did, however, apply for and receive a time extension for the leave permit from the high court.

The court has questioned the government's stance and said that its rules are difficult for them to understand and even disagreed with its notion that every citizen is suspicious. 

Previously, The woman had married an Indian Man and got an X1 Visa with OCI status, later she got divorced and remarried another Indian and the couple now had a 6-month-old daughter.

After this, she submitted her OCI Card and applied for X Visa for which she received an exit notice from the Ministry of home affairs through local police who asked her to leave the country by 24 March 2023.

Justice Patel has further added that they should be right, sensible, and have a humane approach towards the woman and the child. Do not let nationalities come in this way. He even stated that the court won't allow separation for a minute. 

The Bombay High Court has urged the authorities to adopt a compassionate approach and emphasized not separating a nursing mother from her infant just due to nationalities. 

The matter is scheduled for further hearing on 21st August.
